In the Interest of G.M.T., et al., Children--Appeal from 57th Judicial District Court of Bexar County

Annotate this Case
MEMORANDUM OPINION
No. 04-03-00549-CV
IN THE INTEREST OF G.M.T., A.A, AND A.T., CHILDREN,
From the 57th Judicial District Court, Bexar County, Texas
Trial Court No. 2002-PA-00296
Honorable Juan Gallardo, Judge Presiding

PER CURIAM

Sitting: Catherine Stone, Justice

Paul W. Green, Justice

Sarah B. Duncan, Justice

Delivered and Filed: September 24, 2003

DISMISSED

A copy of appellant's notice of appeal was filed in this court on July 17, 2003. The next day, the clerk of the court notified the appellant in writing that our records did not reflect that the filing fee in the amount of $125 was paid. Because our record contains no evidence that appellant is excused by statute or rule from paying the filing fee, see Tex. R. App. P. 5, 20, we ordered appellant to show cause that either: (1) the filing fee had been paid; or (2) appellant is entitled to appeal without paying the filing fee. Appellant did not respond within the time provided.

Several days after our deadline, appellant responded to our order by requesting additional time to file an affidavit of inability to pay costs or give security. Given the amount of time that has passed since appellant's notice of appeal was filed, appellant's request for additional time is denied, and this appeal is dismissed for failure to pay the required filing fee. See Tex. R. App. P. 5, 42.3(c).
