Timothy Kimbrough v. Texas Department of Public Safety--Appeal from County Court at Law No 6 of Bexar County

Annotate this Case
No. 04-01-00352-CV
Timothy KIMBROUGH,
Appellant
v.
TEXAS DEPARTMENT OF PUBLIC SAFETY,
Appellee
From the County Court at Law No. 6, Bexar County, Texas
Trial Court No. 774,690
Honorable M'Liss Christian, Judge Presiding

PER CURIAM

Sitting: Phil Hardberger, Chief Justice

Tom Rickhoff, Justice

Alma L. L pez, Justice

Delivered and Filed: August 31, 2001

DISMISSED FOR LACK OF JURISDICTION

Appellant's driver's license was suspended by the trial court as part of his sentence in a criminal proceeding. Appellant filed a notice of appeal, appealing his criminal conviction in appellate cause number 04-01-00273-CR. Appellant also filed a separate notice of appeal seeking to appeal the suspension of his driver's license. Because the suspension was part of appellant's sentence in the criminal proceeding and not the result of an administrative proceeding, appellant must raise any issues regarding the suspension in appeal number 04-01-00273-CR. Accordingly, this appeal is dismissed for lack of jurisdiction.
