MOTION TO DISMISS GRANTED; MOTION FOR SANCTIONS DENIED; APPEAL DISMISSED FOR LACK OF PROSECUTION

On February 23, 2000, appellee filed a motion to dismiss and for sanctions, citing appellant's delay and failure to file a brief. We previously granted appellant extensions of time to file a brief totaling 120 days, with the notice that "no further extensions of time will be given." Appellant's brief was due January 20, 2000. Appellant has not filed a brief nor has she responded to the motion to dismiss and for sanctions.

We may dismiss an appeal on the motion of any party for failure to prosecute or because the appellant has failed to comply with a requirement of the Rules of Appellate Procedure or an order of this court. See Tex. R. App. P. 42.3(b), (c).

Accordingly, we grant appellee's motion to dismiss and dismiss the appeal for lack of prosecution. We deny the motion for sanctions.
