See TEX. R. APP. P. 38.1. On September 14, 2012, we directed him to file a brief that complied with the rule within ten days. Id. We cautioned appellant that if he failed to file an amended brief as directed, his appeal would be dismissed without further notice. As of today=s date, appellant has not filed an amended brief. Accordingly, we dismiss the appeal. See TEX. R. APP. P. 38.8(a)(1) & 42.3(b) & (c).
