MEMORANDUM OPINION
Before Justices Richter, Lang-Miers, and Murphy
On October 16, 2009, appellant filed a notice of appeal. Because the notice of appeal did not satisfy the requirements of Texas Rule of Appellate Procedure 25.1(d), on November 4, 2009, the Court sent appellant a letter identifying the deficiencies in the notice of appeal and directing him to file an amended notice of appeal within ten days. Appellant was also notified by letter dated November 4, 2009 that he was required to pay the $175 filing fee for the appeal within ten days. The letter warned appellant that failure to pay the filing fee would result in dismissal of the appeal. Appellant did not respond to either letter.
On February 19, 2010, the Court sent a second letter to appellant directing him to file an amended notice of appeal within ten days. We warned appellant that failure to comply would result in dismissal of the appeal. To date, appellant has not responded to the letter.
The Court also sent the letter to the Dallas County District Clerk and the court reporter, inquiring about the status of any contest filed to appellant's affidavit of indigence. On March 1, 2010, we received a copy of the trial court's October 26, 2009 order sustaining the contest to the affidavit of indigence and declaring appellant is not indigent.
Because appellant has neither paid his filing fee nor complied with the directives of this Court, we dismiss the appeal. See Tex. R. App. P. 42.3(c).
