Before Chief Justice Wright and Justices O'Neill and Myers
        By letter dated September 21, 2010, the Court notified appellant that his brief is overdue. We directed appellant to file, within ten days, both his brief and extension motion, and we warned that failure to comply would result in dismissal of the appeal. See Tex. R. App. P. 38.8(a). To date, appellant has neither filed a brief or otherwise communicated with the Court regarding the appeal.
