MEMORANDUM OPINION
Before Chief Justice Wright and Justices O'Neill and Myers
        On January 4, 2008, we abated the appeal upon appellant's filing of bankruptcy. In response to our letter inquiring about the status of the bankruptcy proceedings, we received a letter from appellee's counsel stating the parties settled their dispute and the appeal should be dismissed. Accordingly, we dismiss the appeal. See generally Tex. R. App. P. 42.1.
