Before Chief Justice Thomas and Justices O'Neill and Murphy
By letters dated July 30, 2009 and August 6, 2009, the Court directed appellant to pay the filing fee for the appeal within ten days. We further warned that failure to pay the filing fee would result in dismissal of the appeal without further notice. To date appellant has neither paid the filing fee nor otherwise communicated with the Court regarding the appeal. Accordingly, we dismiss the appeal. See Tex. R. App. P. 42.3.
