FILED: October 16, 2013 IN THE COURT OF APPEALS OF THE STATE OF OREGON In the Matter of K. L., Alleged to be a Mentally Ill Person. STATE OF OREGON, Respondent, v. K. L., Appellant. Multnomah County Circuit Court 130261623 A153731 Connie L. Isgro, Judge pro tempore. Submitted on September 06, 2013. Garrett A. Richardson and Multnomah Defenders, Inc., filed the brief for appellant. Ellen F. Rosenblum, Attorney General, Anna M. Joyce, Solicitor General, and Kathleen Cegla, Senior Assistant Attorney General, filed the brief for respondent. Before Armstrong, Presiding Judge, and Nakamoto, Judge, and Egan, Judge. PER CURIAM Reversed. 1 PER CURIAM 2 Appellant seeks reversal of an order committing her as a mentally ill person 3 for a period not to exceed 180 days. ORS 426.130. In her second assignment of error, 4 she contends that the state failed to prove, by clear and convincing evidence, that, as the 5 result of a mental disorder, she is dangerous to herself or others. ORS 426.005(1)(e)(A). 6 The state concedes that the evidence is legally insufficient to support the involuntary 7 commitment and that the order should be reversed. We agree, accept the state's 8 concession, and reverse on that basis. Accordingly, we do not address appellant's other 9 assignment of error, in which she argues that the trial court erred in not advising her of all 10 of the potential consequences of the civil commitment proceeding as required by ORS 11 426.100(1). 12 Reversed. 1
