Defendant : : : : : : : : : : : : : : : : : : {¶ 1} On May 19, 2005, plaintiff filed a complaint against defendant, Trumbull Correctional Institution. Plaintiff did not submit the filing fee or a poverty statement with the complaint. On May 20, 2005, this court sent plaintiff a notice to pay filing fee. The notice required plaintiff to submit the filing fee or a poverty statement. {¶ 2} On July 15, 2005, defendant filed a motion to dismiss based on plaintiff s failure to submit either the filing fee or a poverty statement. On August 16, 2005, this court granted plaintiff s motion for extension of time to respond to defendant s motion to dismiss. Plaintiff has not filed a response to defendant s motion to dismiss or submitted the filing fee or a poverty statement. {¶ 3} Having considered all the evidence in the claim file and, for the reasons set forth above, defendant s motion to dismiss is GRANTED. Plaintiff s case is DISMISSED, without prejudice. court shall absorb the court costs of this case.
