April 25, 2005, this court issued a return of On complaint form/direction to complete form requiring plaintiff to name an appropriate defendant and provide an address so that the complaint can be served. On April 25, 2005 and June 22, 2005, this court sent notices to plaintiff requesting the filing fee or a poverty statement be submitted. Plaintiff has failed to respond. On September 15, 2005, this court issued an entry ordering plaintiff to submit either the filing fee or a poverty statement within 30 days or face dismissal of his case. The court also reviewed the pleadings and determined the appropriate defendant in this action was the Department of Transportation. The Department of Transportation was added as a defendant in this action. {¶ 2} A check of the docket reveals plaintiff has failed to comply with this court entry since he has not submitted the filing fee or a poverty statement. Accordingly, plaintiff s case is DISMISSED without prejudice. The court shall absorb the court costs of this case.
