{¶ 1} On April 21, 2005, plaintiff filed a complaint against
defendant, the City of Akron. On April 22, 2005, this court issued
an entry dismissing the City of Akron as defendant since the city
is not a state entity as is required by R.C. 2743.02(D).
On August
25, 2005, this court issued an entry naming the Department of
Transportation as defendant and requiring plaintiff to submit the
filing fee or a poverty statement or face dismissal of his case.
A
review of the docket reveals plaintiff has failed to submit either
the filing fee or a poverty statement.
