On August 31, 2001, the magistrate issued a decision wherein defendant s motion to dismiss pursuant to Civ.R. 41(B) was granted. Civ.R. 53 states: Within fourteen days of the filing of a magistrate s decision, a party may file written objections to the magistrate s decision. Plaintiff has not filed an objection to the decision. Upon review of the record and the magistrate s decision, the court determines that there is no error of law or other defect on the face of the magistrate s decision. Therefore, the court adopts the magistrate s decision and recommendation as its own. Plaintiff s case is hereby DISMISSED pursuant to Civ.R. 41(B). Court costs are assessed against plaintiff.
