Ohio Dept. of Transp. (2001), 92 Ohio St. 3d 376. for reconsideration was denied. A motion The July 25, 2001, judgment entry provides in relevant part: This cause, here on appeal from the Court of Appeals for Franklin County, was considered in the manner prescribed by law. On consideration thereof, the judgment of the court of appeals is affirmed consistent with the opinion rendered herein. It is further ordered that the appellee recover from the appellant its costs herein expended; and that a mandate be sent to the Ohio Court of Claims to carry this judgment into execution; and that a copy of this entry be certified to the Clerk of the Court of Appeals for Franklin County for entry. Ohio Dept. of Transp., 2001-Ohio-3949.] In accordance with the order of the Ohio Supreme Court, the court s May 25, 1999, judgment entry in favor of plaintiff is hereby VACATED and judgment is entered in favor of defendant.
