Appeal from an order of the Civil Court of the City of New York, Kings County (Wavny Toussaint, J.), entered June 3, 2010. The order denied plaintiff's motion for summary judgment and granted defendant's cross motion for summary judgment dismissing the complaint.


ORDERED that the order is affirmed, without costs.

For the reasons stated in Alfa Med. Supplies, Inc. as Assignee of Antonio Santos v GEICO Gen. Ins. Co. (__ Misc 3d __ , 2012 NY Slip Op __ [Appeal No. 2011-58 K C], decided herewith), the order is affirmed.
