DECISION & ORDER Motion by Jeffrey J. Weinsten for reinstatement as an attorney and counselor-at-law. Mr. Weinsten was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the First Judicial Department on April 11, 1968, under the name Jeffrey Joseph Weinsten. By decision and order on motion of this Court dated May 6, 1999, Mr. Weinsten was suspended from the practice of law upon his conviction of a serious crime, and the matter was referred to the Honorable Jerome M. Becker, as Special Referee to hear and report. By opinion and order of this Court dated December 11, 2000, Mr. Weinsten was disbarred, effectively immediately, based upon three charges of professional misconduct (see Matter of Weinsten, 279 AD2d 130). By decision and order on motion of this Court dated June 10, 2008, as amended June 20, 2008, Mr. Weinsten's first motion for reinstatement was denied. By decision and order on motion of this Court dated January 14, 2010, Mr. Weinsten's second motion for reinstatement was denied. By decision and order on motion of this Court dated August 15, 2011, Mr. Weinsten's third motion for reinstatement was held in abeyance and the matter was referred to the Committee on Character and Fitness to investigate and report on his current fitness to be an attorney, including, but not limited to, a review of (1) the determination of the United States District Court, Eastern District of New York, dated January 6, 1998, in the matter entitled United States v Weinsten (see 1998 WL 3381, 1998 US Dist Lexis 61); (2) the sentencing minutes for Mr. Weinsten's underlying conviction; (3) the pre-sentencing report prepared by the United States Probation Department; and (4) Mr. Weinsten's remorse.

Upon the papers filed in support of the motion and the papers filed in relation thereto, and the report of the Committee on Character and Fitness and the exhibits annexed thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that, effective immediately, Jeffrey Joseph Weinsten is reinstated as an attorney and counselor-at-law and the Clerk of the Court is directed to restore the name of Jeffrey Joseph Weinsten to the roll of attorneys and counselors-at-law.
