In an action to recover damages for personal injuries, etc., the plaintiffs appeal from an order of the Supreme Court, Kings County (Kramer, J.), dated February 19, 2008, which denied their motion for summary judgment on the issue of liability.

Ordered that the order is affirmed, with costs.

Ordered that the branch of the motion which was for this Court to take judicial notice of the order dated May 5, 2008, is denied as academic in light of the determination of the appeal from the order dated February 19, 2008. Skelos, J.P., Dillon, Angiolillo and Eng, JJ., concur.
