The People of the State of New York, Respondent,

Dangelo Scott, Appellant.

—Appeal by the defendant from a judgment of the County Court, Rockland County (Resnick, J.), rendered December 10, 2002, convicting him of criminal possession of a weapon in the second degree, upon his plea of guilty, and imposing sentence.

Ordered that the judgment is affirmed, and the matter is remitted to the County Court, Rockland County, for further proceedings pursuant to CPL 460.50 (5).
