DOCKET NO. A-5576-04T35576-04T3

EUGENE BELLUSCI,

Plaintiff-Appellant,

v.

VILLAGE OF RIDGEWOOD,

Defendant-Respondent.

___________________________________

Argued June 6, 2006 - Decided June 28, 2006

Before Judges Skillman and Axelrad.

On appeal from Superior Court of New Jersey, Law Division, Bergen County, Docket No. L-11832-04.

Michael A. Bukosky argued the cause for appellant (Loccke & Correia, attorneys; Mr. Bukosky, on the brief).

Dominick J. Bratti argued the cause for respondent (Grotta, Glassman & Hoffman, attorneys; Mr. Bratti, of counsel; Keith J. Rosenblatt, on the brief).

PER CURIAM

Plaintiff appeals from the summary judgment entered on June 10, 2005, which dismissed his complaint on the grounds that the Law Division lacked jurisdiction over the matter and that plaintiff failed to exhaust the administrative remedies available in his appeal currently pending before the Merit System Board and Office of Administrative Law. We affirm substantially for the reasons set forth in Judge Russello's written opinion on the reverse side of the order granting defendant summary judgment.

Affirmed.
