DOCKET NO. A-4989-04T14989-04T1

MORITZ MENDELOVICI,

Plaintiff-Appellant,

v.

ADDA MENDELOVICI,

Defendant-Respondent.

___________________________________

Submitted May 31, 2006 - Decided June 16, 2006

Before Judges Skillman and Payne.

On appeal from Superior Court of New Jersey, Law Division, Special Civil Part, Bergen County, Docket No. SC-689-05.

Moritz, Mendelovici, appellant, pro se.

Respondent Adda Mendelovici did not file a brief.

PER CURIAM

Plaintiff appeals from a final judgment of the Special Civil Part that dismissed his defamation action based on the evidence presented in a bench trial. In dismissing plaintiff's complaint, Judge Wilson ruled that the claim that plaintiff's deceased brother had been defamed was not actionable because of his death; that there was no evidence of publication of defendant's alleged defamation of plaintiff; and that defendant was immune from liability for any defamatory comments in his counterclaim, which was subsequently withdrawn. We affirm substantially for the reasons expressed in Judge Wilson's oral opinion. Plaintiff's arguments do not merit any additional discussion. R. 2:11-3(e)(1)(E).

Affirmed.
