STATE OF MICHIGAN
COURT OF APPEALS
In the Matter of DEWEY LEE SCOTT
BUTCHER, Minor.
DEPARTMENT OF HUMAN SERVICES,
UNPUBLISHED
January 5, 2010
Petitioner-Appellee,
v
No. 291358
Allegan Circuit Court
Family Division
LC No. 08-042980-NA
AFTER REMAND
DAVID BUTCHER,
Respondent-Appellant,
and
ELAINA BUTCHER and JAMES WILLIAMSON,
Respondents.
Before: Fort Hood, P.J., and Sawyer and Donofrio, JJ.
MEMORANDUM.
In our prior opinion in this matter, we affirmed the trial court’s determination that a
ground existed to terminate respondent father’s parental rights. In re Butcher, unpublished
opinion per curiam (issued October 22, 2009). But we also concluded that the trial court erred in
failing to make a finding regarding whether termination of respondent’s parental rights was in
the child’s best interests. Slip op at 2. Accordingly, we remanded the matter, while retaining
jurisdiction, to the trial court to determine whether termination was in the child’s best interests
and to cite evidence in support of its decision. Id. at 3.
The trial court conducted a hearing on remand, found that termination was in the child’s
best interests, and cited evidence in support of its conclusion. Accordingly, we are satisfied that
the trial court complied with our directives and that it did not clearly err in finding that
termination was in the child’s best interests. In re Trejo Minors, 462 Mich 341, 356-357; 612
NW2d 407 (2000).
