STATE OF MICHIGAN COURT OF APPEALS SUSAN MARIE CZAJKOWSKI KLOSS, UNPUBLISHED December 29, 2005 Plaintiff-Appellee-Cross-Appellant, v No. 257737 St. Clair Circuit Court LC No. 93-001962-DO NORBERT PAUL CZAJKOWSKI, Defendant-Appellant-Cross- Appellee. Before: Murphy, P.J., and Sawyer and Meter, JJ. SAWYER, J. (concurring in part and dissenting in part). Although I concur with most of the majority’s opinion, I respectfully dissent from that portion upholding the alimony decision. While I was a member of the panel in the original appeal in this case which decided that the trial court’s alimony award of $62,400 per year for eight years was inadequate, I did not envision the award being raised to the extent that it has. While that initial award may have been inadequate, the current award is grossly excessive. I would hold that the trial court abused its discretion in the amount of alimony awarded, and I would remand with directions to the trial court to reduce the alimony award to a reasonable amount. /s/ David H.
