STATE OF MICHIGAN COURT OF APPEALS In the Matter of TYRESHA MONIQUE MARTIN and TYREECK SHUKAR MARTIN, Minors. DEPARTMENT OF HUMAN SERVICES, f/k/a FAMILY INDEPENDENCE AGENCY, UNPUBLISHED December 20, 2005 Petitioner-Appellee, v No. 263085 Wayne Circuit Court Family Division LC No. 03-419596-NA TERRENCE MARTIN, Respondent-Appellant, and TAMMY RENEE WISEMAN, Respondent. Before: Owens, P.J. and Saad and Fort Hood, JJ. MEMORANDUM. Respondent-appellant appeals as of right from the trial court order terminating his parental rights to the minor children under MCL 712A.19b(3)(a)(ii), (c)(i), (g), and (j). We affirm. This appeal is being decided without oral argument pursuant to MCR 7.214(E). The trial court did not clearly err in finding that the statutory grounds for termination were established by clear and convincing evidence. MCR 3.977(J); In re Miller, 433 Mich 331, 337; 445 NW2d 161 (1989). The children were adjudicated court wards after respondentappellant was arrested on probation violation charges while the children’s mother was already in jail on a larceny charge. The evidence clearly demonstrated that respondent-appellant failed to comply with almost every requirement of the case treatment plan. He did not regularly attend court hearings and did not attend the permanent custody hearing. Respondent-appellant provided only one drug screen, which was positive for opiates. He did not complete parenting classes and never enrolled in therapy, despite being given referrals. He lacked suitable housing throughout -1- the case. Respondent-appellant failed to visit the children, and failed to maintain contact with the caseworker for more than one year before the permanent custody hearing. Furthermore, the evidence did not show that termination of respondent-appellant’s parental rights was clearly not in the children’s best interests. MCL 712A.19b(5); In re Trejo, 462 Mich 341, 356-357; 612 NW2d 407 (2000). Thus, the trial court did not err in terminating respondent-appellant’s parental rights to the children. Affirmed. /s/ Donald S. Owens /s/ Henry William Saad /s/ Karen M. Fort Hood -2-
