STATE OF MICHIGAN
COURT OF APPEALS
LINDA M. SHAW,
UNPUBLISHED
July 26, 2005
Plaintiff-Appellant,
v
No. 260109
Genesee Circuit Court
LC No. 01-071083-NI
GEORGANNE BOYLAN FREYRE, Personal
Representative of the Estate of JOSEPH
LAWRENCE FREYRE, Deceased,
Defendant-Appellee.
Before: Cooper, P.J., and Fort Hood and R. S. Gribbs*, JJ.
COOPER, P.J. (dissenting).
I must respectfully dissent from the majority opinion of my colleagues. I would find that
plaintiff’s injuries affected her general ability to lead her normal life. Plaintiff was a woman in
her late fifties. Her life was comprised of activities like housework and gardening. As she was
no longer able to do these activities, I would find that plaintiff met the statutory no-fault
threshold. I would, therefore, reverse the trial court’s dismissal of her claims.
/s/ Jessica R. Cooper
* Former Court of Appeals judge, sitting on the Court of Appeals by assignment.
