STATE OF MICHIGAN
COURT OF APPEALS
IRENE INGLIS, Personal Representative of the
Estate of JAMES INGLIS, Deceased,
UNPUBLISHED
August 26, 2004
Plaintiff-Appellant,
v
No. 247066
Oakland Circuit Court
LC No. 01-032693-NH
PROVIDENCE HOSPITAL AND MEDICAL
CENTERS, INC.,
Defendant-Appellee.
Before: Murphy, P.J., and Griffin and White, JJ.
WHITE, J. (concurring).
I agree that plaintiff did not present evidence sufficient for a reasonable juror to find that
there was a joint enterprise between Dr. Hurley and defendant.
With regard to the ostensible agency claim, I concur on the basis that there was
insufficient evidence that the Inglises “looked to” Providence for treatment, Grewe v Mt Clemens
Gen Hosp, 404 Mich 240, 250-251; 273 NW2d 429 (1978), or relied on Providence in making
the appointment with Dr. Hurley. VanStelle v Macaskill, 255 Mich App 1, 13-14; 662 NW2d 41
(2003).
/s/ Helene N. White
