STATE OF MICHIGAN COURT OF APPEALS INTERCONTINENTAL ELECTRONICS, S.P.A., UNPUBLISHED March 18, 2004 Plaintiff/CounterdefendantAppellant, v No. 242455 Oakland Circuit Court LC No. 00-024354-CK AMERICAN KEYBOARD PRODUCTS, INC., ROBERT C. KOTZ and GREGORY WYSOCKI, Defendants/Counterplaintiffs- Appellees. Before: Fort Hood, P.J., and Bandstra and Meter, JJ. BANDSTRA, J. (concurring in part and dissenting in part). I concur with the majority opinion except in its affirmation of the exemplary damages award. Exemplary damages are only compensatory in nature and there must be evidence of “humiliation, sense of outrage, and indignity, resulting from injustices maliciously, willfully, and wantonly inflicted.” McPeak v McPeak (On Remand), 233 Mich App 483, 490; 593 NW2d 180 (1999). Sufficient evidence of this nature was not presented here. /s/ Richard A. Bandstra -1-
