PEOPLE OF THE STATE OF MICHIGAN, Plaintiff-Appellant, v No. 226212 Kent Circuit Court LC No. 99-010577-FH GASPER ESTEBAN, Defendant-Appellee. PEOPLE OF THE STATE OF MICHIGAN, Plaintiff-Appellant, v No. 226213 Kent Circuit Court -1- JAVIER QUINTANA ARELLANO, LC No. 99-010578-FH Defendant-Appellee. Before: Neff, P.J., and Murphy and Griffin, JJ. MEMORANDUM. The people appeal on leave granted defendants’ sentences of twelve months in jail imposed for defendants’ plea-based convictions for third-degree criminal sexual conduct, MCL 750.520(d)(1)(a); MSA 28.788(4)(1)(a). At oral arguments counsel advised the Court that defendants have served their sentences and have been released without parole. Further, defendants have been deported to their native country of Gautemala and are no longer subject to this Court’s jurisdiction. In light of these events, it is now impossible for this Court to fashion a remedy and therefore the sentencing issues raised by the people are moot. People v Rutherford, 208 Mich App 198, 204; 526 NW2d 620 (1994). Appeal dismissed as moot. /s/ Janet T. Neff /s/ William B. Murphy /s/ Richard Allen Griffin -2-
