I do not agree that the document at issue assigned plaintiff’s claim against defendant to the Irish American Club and its insurer, or that the document includes an agreement not to sue unrelated entities such as defendant except at the club’s or its insurer’s request. Nevertheless, I concur in the result because I agree with defendant’s claim that he was entitled to a set-off for amounts paid by the settling defendant for compensation for plaintiff’s single injury. /s/ Helene N.
