STATE OF MICHIGAN
COURT OF APPEALS
LORRAINE ROSER,
UNPUBLISHED
March 3, 2000
Plaintiff-Appellant,
v
LINDA RUTH CLEMENTS and KEVIN
CLEMENTS,
No. 210752
Macomb Circuit Ct
LC No. 97-005947-NI
Defendants-Appellees.
Before: O’Connell, P.J., and Murphy and Jansen, JJ.
MEMORANDUM.
Plaintiff appeals as of right from the circuit court’s order granting defendants’ motion for
summary disposition on the basis that plaintiff’s action was barred by res judicata. We affirm.
Plaintiff’s claims for damages arising out of the May 10, 1996, automobile accident properly
belonged to the prior litigation between the parties, which involved the same May 10, 1996, automobile
accident. Plaintiff’s second complaint was therefore barred under the doctrine of res judicata. Pierson
Sand & Gravel, Inc v Keeler Brass Co, 460 Mich 372, 380; 596 NW2d 153 (1999).
Affirmed.

/s/ William B. Murphy
/s/ Kathleen Jansen
