STATE OF MICHIGAN COURT OF APPEALS PEOPLE OF THE STATE OF MICHIGAN, UNPUBLISHED June 9, 1998 Plaintiff-Appellee, v No. 195466 Macomb Circuit Court LC No. 92-001447 FH ALAN COLBURN THORNE, Defendant-Appellant. Before: Jansen, P.J., and Kelly and Markey, JJ. PER CURIAM. Defendant appeals as of right from the trial court’s extension of his probation by one year, following a determination that he violated his probation by possessing a registered gun. We affirm. Defendant argues that the trial court erred in extending the length of his probation because the prosecution failed to prove by a preponderance of the evidence that he possessed a gun while on probation. However, because defendant has already served the term of his probation, we decline to review this issue. Where a subsequent event renders it impossible for this Court to fashion a remedy, an issue becomes moot. People v Rutherford, 208 Mich App 198, 204; 526 NW2d 620 (1994). Affirmed. /s/ Kathleen Jansen /s/ Michael J. Kelly /s/ Jane E. Markey -1
