STATE OF MICHIGAN COURT OF APPEALS PEOPLE OF THE STATE OF MICHIGAN, UNPUBLISHED February 10, 1998 Plaintiff-Appellee, v No. 194674 Macomb Circuit Court LC No. 94-002078 FH & 94-002079 FH DHIA SHAKAIR KALASHO, Defendant-Appellant. Before: Gage, P.J., and Murphy and Reilly, JJ. MEMORANDUM. On these appeals of right, defendant, who was convicted of various drug offenses on pleas of guilty, claims that his statutory speedy trial right under MCL 780.131; MSA 28.969(1) was violated, thereby depriving the trial court of subject matter jurisdiction. Since defendant was in federal prison, and not in a state prison, we think it would be the interstate agreement on detainers, MCL 780.601 et seq.; MSA 4.147(1) et seq., that would apply, but in either event defendant’s unconditional pleas of guilty waived all such statutory speedy trial rights. People v Bordash, 208 Mich App 1, 2-3; 527 NW2d 17 (1994), conflict panel refused 208 Mich App 801; 527 NW2d 19 (1994). Waiver also applies under the interstate agreement on detainers. People v Wanty, 189 Mich App 291; 471 NW2d 922 (1991). Affirmed. /s/ Hilda R. Gage /s/ William B. Murphy /s/ Maureen Pulte Reilly -1
