COURT OF APPEALS
PEOPLE OF THE STATE OF MICHIGAN,
UNPUBLISHED
July 15, 1997
Plaintiff-Appellee,
v
No. 189938
St. Joseph Circuit Court
LC No. 94-007771 FH
TONY JOE ORSIE,
Defendant-Appellant.
Before: Cavanagh, P.J., and Doctoroff and D.A. Teeple*, JJ.
MEMORANDUM.
Defendant pleaded guilty to prison escape, MCL 750.193; MSA 28.390, and received an
enhanced sentence of 3 to 7-1/2 years in prison, reflecting his status as a second offender. Defendant
appeals as of right. We affirm.
Defendant’s sentence does not violate the principle of proportionality, in light of the benefit
bestowed upon defendant by the plea agreement and defendant’s extensive criminal activities while on
escape status. People v Austin, 209 Mich App 564, 571; 531 NW2d 811 (1995); People v Ward,
206 Mich App 38, 44-45; 520 NW2d 363 (1994); People v Duprey, 186 Mich App 313, 318; 463
NW2d 240 (1990).
Affirmed.
