MEMORANDUM.
Defendant pleaded nolo contendere to second-degree murder, MCL 750.317; MSA 28.549,
kidnapping, MCL 750.249; MSA 28.446, and possession of a firearm during the commission of a
felony (two counts), MCL 750.227b; MSA 28.424(2) For those respective convictions, he was
sentenced to life imprisonment, twenty-five to forty years’ imprisonment, and two years’ consecutive
imprisonment (two terms). He appeals as of right. We affirm. This case has been decided without oral
argument pursuant to MCR 7.214(A).
When a defendant is sentenced on multiple charges, the court may rely on a presentence report
for the highest offense. People v Gonzalez, 197 Mich App 385; 496 NW2d 312 (1992).
Defendant’s sentences are not disproportionate. People v Milbourn, 435 Mich 630; 461 NW2d 1
(1990); People v Kelly, 213 Mich App 8; 539 NW2d 538 (1995).
Affirmed.
