COURT OF APPEALS
PEOPLE OF THE STATE OF MICHIGAN,
UNPUBLISHED
February 28, 1997
Plaintiff-Appellee,
v
No. 184392
Muskegon Circuit
LC No. 94-037539-FH
ANITA LOUISE BALOGH,
Defendant-Appellant.
Before: D.F. Walsh,* P.J., and R.P. Griffin** and W.P. Cynar,* JJ.
MEMORANDUM.
Defendant pleaded guilty to possession of less than twenty-five grams of cocaine, MCL
333.7403(2)(a)(v); MSA 14.15(7403)(2)(a)(v), and delivery of less than fifty grams of cocaine, MCL
333.7401(2)(a)(iv); MSA 14.15(7401)(2)(a)(iv). For those respective convictions, she was sentenced
to consecutive terms of one to four years’ imprisonment and four to twenty years’ imprisonment. She
appeals as of right. We affirm. This case has been decided without oral argument pursuant to MCR
7.214(A).
We reject defendant’s challenge to the proportionality of her sentences. Defendant was
sentenced in accordance with a sentence agreement. The agreement demonstrates defendant’s
acknowledgement of the proportionality of the sentences. People v Cobbs, 443 Mich 276, 285 n 11;
505 NW2d 208 (1993); People v Rodriguez, 212 Mich App 351, 355; 538 NW2d 42 (1995).
Additionally, the proportionality of a sentence is to be assessed without regard to the effect of its
consecutive nature. People v Hardy, 212 Mich App 318, 320; 537 NW2d 267 (1995).
