However, under the facts of this case, I do not believe this defendant knowingly submitted to testing with full awareness the results could be used against her in a criminal investigation. It is well-settled Miranda does not apply to all government employees. See, State v. Bernard, 09-1178 (La. 3/16/10), 31 So. 3d 1025. However, the DCFS worker clearly had a connection to the State, and was presumably bound by law to forward the positive drug test results to law enforcement officials. Thus, I believe she acted as an agent of law enforcement.
