ORDER The appellant, Logan Smith, asks this court to grant an extension of time in which to file a pro se appellate brief in the captioned appeal. The appellant also asks this court to order the Department of Corrections, through David Wade Correctional Center, to allow him unrestricted access to his trial record while housed in the custody of the Department of Corrections and requests this court to order that he be provided one free copy of his trial transcripts. Each of the appellant’s requests are hereby denied. An extension of time within which to file a brief may be granted by the court for good cause shown on written motion filed with the clerk of the court on or before the date the brief is due. U.R.C.A. 212.8. Defendant filed two requests for an extension of time, and both were filed “on or before the date the brief [was] due.” Given the restriction of law library access and the significant right of access to the courts at issue, I believe defendant has shown good cause for this Court to grant him additional time to file his pro se brief. Further, the matter has not yet been placed on a docket; therefore, an extension of time will not thwart or unduly delay a determination of the case. Accordingly, in the interest of justice, I would grant defendant’s request for an extension of time to file his pro se brief.
