There was no evidence that Eagle directed or in any way controlled the operation of the boat and thus it is not liable. See P & E Boat Rentals, Inc. v. Ennia General Ins. Co., 872 F.2d 642 (5th Cir. 1989)(finding a time charterer liable for its own negligent acts).
