IN THE COURT OF APPEALS OF IOWA No. 2-1052 / 11-0632 Filed February 13, 2013 DEWITT MICHAEL WELLS, Applicant-Appellant, vs. STATE OF IOWA, Respondent-Appellee. ________________________________________________________________ Appeal from the Iowa District Court for Scott County, Thomas G. Reidel, Judge. Defendant appeals the denial of his application for postconviction relief. AFFIRMED. Jack E. Dusthimer, Davenport, for appellant. Thomas J. Miller, Attorney General, Jean C. Pettinger, Assistant Attorney General, Michael J. Walton, County Attorney, and Julie Walton, Assistant County Attorney, for appellee State. Considered by Eisenhauer, C.J., and Vogel and Vaitheswaran, JJ. Tabor, J., takes no part. 2 EISENHAUER, C.J. DeWitt Wells appeals from a ruling denying postconviction relief. Regarding his claim trial counsel rendered ineffective assistance, we affirm without opinion. See Iowa R. App. P. 6.1203(a), (d). Assuming without deciding error was preserved on his claim of prosecutorial misconduct, we find no merit to this claim. AFFIRMED.
