NO. 25139 ASSOCIATION OF APARTMENT OWNERS OF KAANAPALI ALII, an unincorporated condominium association, by its Board of Directors, Plaintiff-Respondent, vs. RICHARD J. WILLIAMS and JUDITH MARIANNE WILLIAMS, Defendants-Petitioners, and JOHN DOES 1-50; JANE DOES 1-50; DOE ASSOCIATIONS 1-50; DOE PARTNERSHIPS 1-50; DOE CORPORATIONS 1-50; AND DOE GOVERNMENTAL AGENCIES 1-50, Defendants. _________________________________________________________________ ORIGINAL PROCEEDING (Civ. No. 02-1-0126(3)) (By: ORDER Moon, C.J., Levinson, Nakayama, Ramil, and Acoba, JJ.) Upon consideration of the petition for a writ of mandamus directed to a judge filed by Petitioners Richard J. Williams and Judith Marianne Williams, the papers in support, and the records and files herein, it appears that: (1) Petitioners are seeking immediate review of a ruling in Apartment Owners of Kaanapali Alii v. Williams, Civil No. 02-1-0126, presently pending in the Circuit Court of the Second Circuit; (2) Petitioners fail to demonstrate that they are entitled to a writ of mandamus. Therefore, IT IS HEREBY ORDERED that the petition for a writ of mandamus directed to a judge is denied without prejudice to any remedy Petitioners have in the pending circuit court case and without prejudice to any remedy Petitioners have by way of appeal. DATED: Honolulu, Hawai#i, July 29, 2002.
