ORDER AMENDING OPINION OF THE COURT The opinion of the court filed on June 3, 2004 is hereby amended as follows: On page 9, in the third line of the second full paragraph, the date "December 12, 2002" shall be replaced with -1- FOR PUBLICATION "December 12, 2001," so that the sentence reads, in relevant part: "Final judgment in favor of Defendants was entered on December 12, 2001, and Hayes filed a second notice of appeal on January 10, 2002."
