The opinion of the court, filed on July 29, 2004, is hereby amended to correct a glitch in the numbering of footnotes as follows: 1. On page 11, the reference to footnote 4 in the text and footnote should be renumbered as footnote 6. 2. On page 12, the reference to footnote 5 in the text and footnote should be renumbered as footnote 7. 3. On page 14, the reference to footnote 6 in the text and footnote should be renumbered as footnote 8. 4. On page 15, the reference to footnote 7 in the text and footnote should be renumbered as footnote 9. 5. On page 18, the reference to footnote 8 in the text and footnote should be renumbered as footnote 10. 6. On page 18, the reference to footnote 9 in the text and footnote should be renumbered as footnote 11. 7. On page 22, the reference to footnote 10 in the text and footnote should be renumbered as footnote 12. 8. On page 22, the reference to footnote 11 in the text and footnote should be renumbered as footnote 13. 9. On page 23, the reference to footnote 12 in the text and footnote should be renumbered as footnote 14. 10. On page 23, the reference to footnote 13 in the text and footnote should be renumbered as footnote 15. The opinion of the court is further amended to correct the identification of appellate counsel on page 32 to read as follows: Mangmang Qiu Brown Deputy Prosecuting Attorney City and County of Honolulu for plaintiff-appellee.
