IN THE DISTRICT COURT OF APPEAL FIRST DISTRICT, STATE OF FLORIDA TRAVIS KEELS, Petitioner, v. NOT FINAL UNTIL TIME EXPIRES TO FILE REHEARING MOTION AND DISPOSITION THEREOF IF FILED. CASE NO. 1D05-4436 STATE OF FLORIDA, Respondent. Opinion filed November 7, 2005. Petition for Writ of Habeas Corpus -- Original Jurisdiction. Travis Keels, pro se, petitioner. Charlie Crist, Attorney General, Tallahassee, for respondent. PER CURIAM. In this habeas corpus petition, Travis Keels claims entitlement to relief because the circuit court failed to conduct an evidentiary hearing and allow a witness to testify who was identified in Keels postconviction motion. The place to make this argument was in the initial brief filed by petitioner in case number 1D05-3640, his appeal from the order denying the motion for postconviction relief. Accordingly, the petition for writ of habeas corpus is denied. PETITION DENIED. ALLEN, WEBSTER and THOMAS, JJ., concur.
