CHAVEZ, Warden, ) ) Respondent. ) No. C 11-5392 CRB (PR) ORDER DENYING CERTIFICATE OF APPEALABILITY (Docket # 12) 11 12 Petitioner has filed a notice of appeal and request for a certificate of 13 appealability (COA) under 28 U.S.C. § 2253(c) and Federal Rule of Appellate 14 Procedure 22(b) following the court's July 30, 2012 order granting respondent's 15 motion to dismiss the petition as untimely. 16 Petitioner's request for a COA (docket # 12) is DENIED because 17 petitioner has not made "a substantial showing of the denial of a constitutional 18 right." 28 U.S.C. § 2253(c)(2). Petitioner has not demonstrated that "jurists of 19 reason would find it debatable whether the petition states a valid claim of the 20 denial of a constitutional right and that jurists of reason would find it debatable 21 whether the district court was correct in its procedural ruling." Slack v. 22 McDaniel, 529 U.S. 473, 484 (2000). 23 The clerk shall forward to the court of appeals the case file with this order. 24 See United States v.
