FELKER, 14 / 15 Petitioner, a state prisoner proceeding pro se, has filed an application for a writ of 16 17 habeas corpus pursuant to 28 U.S.C. § 2254. Court records reveal that petitioner has previously 18 filed an application for a writ of habeas corpus attacking the conviction and sentence challenged 19 in this case.1 The previous application was filed on March 29, 2004, and was denied on the 20 merits on April 2, 2007. Before petitioner can proceed with the instant application he must move 21 in the United States Court of Appeals for the Ninth Circuit for an order authorizing the district 22 court to consider the application. 28 U.S.C. § 2244(b)(3). Therefore, petitioner's application 23 must be dismissed without prejudice to its refiling upon obtaining authorization from the United 24 States Court of Appeals for the Ninth Circuit. 25 26 1 Hally v.
