United States of America, Respondent-appellee, v. Antonio Garfield Black, Petitioner-appellant, 60 F.3d 835 (9th Cir. 1995)

Annotate this Case
US Court of Appeals for the Ninth Circuit - 60 F.3d 835 (9th Cir. 1995) Submitted June 26, 1995. *Decided July 3, 1995

MEMORANDUM**

Before: O'SCANNLAIN, LEAVY, and HAWKINS, Circuit Judges.

Antonio Black appeals the denial of his motion to vacate his sentence under 28 U.S.C. § 2255. Having conducted a de novo review, we affirm for the reasons stated by the district court. The district court did not err by denying the recusal motion. See United States v. Studley, 783 F.2d 934, 939-40 (9th Cir. 1986) (recusal not required merely because litigant sued the judge).

AFFIRMED.
