United States of America, Plaintiff Appellee, v. Eddie Ray Tucker, Defendant Appellant, 37 F.3d 1497 (4th Cir. 1994)
Annotate this CaseAppeal from the United States District Court for the Western District of North Carolina, at Charlotte. Robert D. Potter, Senior District Judge. (CR-90-84, CA-92-364)
Eddie Ray Tucker, appellant pro se.
Harry Thomas Church, Asst. U.S. Atty., Charlotte, N.C., for appellee.
W.D.N.C.
AFFIRMED.
Before ERVIN, Chief Judge, and WILKINSON and HAMILTON, Circuit Judges.
PER CURIAM:
Appellant appeals from the district court's order denying his 28 U.S.C. § 2255 (1988) motion.* Our review of the record and the district court's opinion accepting the recommendation of the magistrate judge discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Tucker, Nos. CR-90-84; CA-92-364 (W.D.N.C. Feb. 2, 1993). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
AFFIRMED
The Court previously remanded the case for a determination whether the notice of appeal period should be reopened. The district court reopened the appeal period and Appellant filed a timely notice of appeal
