This appeal has been referred to a panel of the court pursuant to Rule 9(a), Rules of the Sixth Circuit.

A review of the documents before the court indicates that the magistrate entered on December 21, 1990, a report and recommendation recommending that the 28 U.S.C. § 2255 motion to vacate be denied. Havlovic appealed on January 6, 1991, from the December 21 report and recommendation.
