MEMORANDUM** 

Jeffrey A. Sagorsky appeals the district court's order revoking his probation. Sagorsky contends that the district court erred by revoking his probation because the district judge automatically imposed the maximum term of imprisonment. We have jurisdiction under 28 U.S.C. § 1291.

We review for an abuse of discretion or fundamental unfairness a district court's decision to revoke probation. United State v. Tham, 884 F.2d 1262, 1264 (9th Cir. 1989).

After careful consideration we find no abuse of discretion.

AFFIRMED.
