MEMORANDUM**
The issues raised in this appeal are moot because of our decision in United States v. Kersting, 891 F.2d 1407, 1413 (9th Cir. 1989), petition for cert. filed, 58 U.S.L.W. 3755 (May 29, 1990) (No. 89-1774). The judgment of the district court is vacated, and the case is remanded with instructions to dismiss the action as moot. United States v. Munsingwear Inc., 340 U.S. 36, 39-40 (1950).
VACATED AND REMANDED WITH INSTRUCTIONS TO DISMISS AS MOOT.
The panel unanimously finds this case suitable for disposition without oral argument. Fed. R. App. P. 34(a); 9th Cir.R. 34-4. Accordingly, appellants' request for oral argument is denied
