MEMORANDUM** 

The issues raised in this appeal are moot because of our decision in United States v. Kersting, 891 F.2d 1407, 1413 (9th Cir. 1989), petition for cert. filed, 58 U.S.L.W. 3755 (May 29, 1990) (No. 89-1774). The judgment of the district court is vacated, and the case is remanded with instructions to dismiss the action as moot. United States v. Munsingwear Inc., 340 U.S. 36, 39-40 (1950).

VACATED AND REMANDED WITH INSTRUCTIONS TO DISMISS AS MOOT.
