MEMORANDUM** 

Arnold Dean appeals his conviction, following a bench trial, for distribution of cocaine base within 1,000 feet of a school, in violation of 21 U.S.C. §§ 841(a) (1) and 845a, and possession of cocaine base with intent to distribute, in violation of 21 U.S.C. § 841(a) (1).

Counsel for Dean filed a brief pursuant to Anders v. California, 386 U.S. 738 (1967), stating that there are no issues that could be reviewed by this court. Dean did not file a supplemental pro se brief. Our independent review of the record pursuant to Penson v. Ohio, 109 S. Ct. 346, 351 (1988), discloses no issues for review.

Therefore, the district court's judgment is affirmed and the motion of Marcia J. Brewer, Esq., to withdraw as counsel of record is granted.

AFFIRMED.
